Terms and Conditions of Sale

1. Introduction

These Terms and Conditions apply to consumer purchases made through our online store. The purchase is governed by these terms together with applicable mandatory consumer protection laws, including the EU Consumer Rights Directive, the E-Commerce Directive, the General Data Protection Regulation (GDPR), and local consumer legislation depending on your country of residence. These laws grant consumers certain mandatory rights that cannot be waived by contract.

These Terms are not intended to limit any statutory rights but to clarify the rights and obligations of both parties under this agreement.

3. The Buyer

The Buyer is any consumer who places an order via our online store. By placing an order, you confirm that you are at least 18 years old or have permission from a parent or legal guardian.

4. Pricing

All prices shown include applicable VAT and any other applicable taxes or charges. The total price payable will be displayed before you complete your purchase. No additional costs will be charged after the purchase unless expressly agreed between the parties.

5. Formation of Contract

The contract becomes binding once the Buyer has submitted the order and received an order confirmation from the Seller.

However, the contract is not binding if there has been an obvious typographical or pricing error that the Buyer knew or should reasonably have known to be incorrect.

6. Payment

Payment must be made using one of the payment methods available on the website. The amount is reserved at the time of order and charged when the goods are dispatched.

For invoice payments (where available), invoices are issued upon shipment through a third-party payment provider. The payment due date will be at least 14 days from receipt of the goods.

Customers under the age of 18 may not pay by invoice with deferred payment.

7. Delivery

Delivery is deemed completed when the Buyer, or someone authorized by the Buyer, has received the goods.

If no delivery time is stated, we will deliver the goods without undue delay and no later than 30 days after the order was placed. Delivery will be made to the address provided by the Buyer unless otherwise agreed.

Delivery options include parcel delivery to the mailbox or pickup point via Bring.

Delivery time: 3–6 business days after dispatch from our warehouse.
Handling time: Orders are typically processed within 3 business days after receipt of order.
Notifications: You will receive SMS and/or email updates when the shipment is delivered or ready for pickup.

Extended pickup period: If you need to extend the pickup period, please contact Bring customer service via https://www.bring.no/kundeservice/kontakt-oss to request an extension of up to 10 days.

8. Transfer of Risk

The risk for the goods transfers to the Buyer once delivery has been completed in accordance with Section 7.

9. Right of Withdrawal (Cancellation Right)

You have the right to withdraw from your purchase within 14 days without giving any reason. The withdrawal period begins on the day after you, or a person designated by you (other than the carrier), receives the goods.

To exercise your right of withdrawal, you must notify us clearly via email or letter before the withdrawal period expires. You may, but are not required to, use our withdrawal form.

Effects of withdrawal:

  • We will refund the purchase price, including standard delivery costs.
  • Any additional costs for non-standard delivery methods will not be refunded.
  • Refunds will be made without undue delay, and no later than 14 days after we have received your notice of withdrawal.
  • We may withhold the refund until we have received the returned goods or you have provided documentation confirming the return.
  • Goods must be returned within 14 days after notification of withdrawal.
  • You are responsible for the cost of return shipping.
  • You may handle or inspect the goods to determine their nature, characteristics, and functionality. However, you are liable for any diminished value caused by handling beyond what is necessary for such assessment.

10. Complaints and Defects

If a defect arises, you must notify us within a reasonable time after discovering the defect. A complaint made within 2 months of discovery is always considered timely.

The right to complain applies for 2 years after delivery. If the goods are intended to last substantially longer, the complaint period is 5 years.

In the event of a defect, you may:

  • Withhold payment
  • Demand repair or replacement
  • Request a proportional price reduction
  • Cancel the contract if the defect is significant
  • Claim compensation if applicable

     

Complaints should preferably be submitted in writing.

11. Seller’s Rights in Case of Buyer’s Default

If the Buyer fails to fulfill their payment or other obligations, and this is not due to the Seller, the Seller may:

  • Withhold delivery
  • Demand performance
  • Cancel the contract
  • Claim compensation
  • Charge interest and collection fees in accordance with applicable laws

     

For uncollected non-prepaid items, the Seller may charge a fee covering actual delivery and handling costs. This fee will not apply to Buyers under 18 years of age.

12. Warranty

Any warranty provided by the Seller or manufacturer grants additional rights beyond mandatory consumer protection laws. Warranties do not limit your statutory rights related to defects or delays.

13. Personal Data

PortalOne AS is the data controller for personal data collected through the website. Personal data is processed in accordance with applicable data protection regulations (including GDPR), and only for purposes necessary to fulfill the agreement or as otherwise permitted by law.

Data will not be shared with third parties unless necessary to complete the transaction or required by law. Please see our Privacy Policy for further information.

14. Governing Law and Dispute Resolution

We strive to resolve any complaints directly. You may contact us via merch@portalone.com.

If we cannot reach an amicable solution, consumers may contact the Norwegian Consumer Authority (Forbrukertilsynet) at www.forbrukertilsynet.no or phone +47 23 400 600 for mediation.

You may also use the EU Commission’s Online Dispute Resolution platform: http://ec.europa.eu/odr, particularly if you reside in an EU/EEA country other than Norway.

The agreement is governed by Norwegian law, without prejudice to any mandatory consumer protection rights granted under the law of your country of residence.
